1. Agreement to these Terms

These Terms of Service (“Terms”) govern your access to and use of www.anthonycrudele.com and any related content, podcasts, videos, newsletters, courses and services (together, the “Site”). The Site is operated by Crudele Productions Inc. (“CPI”, “we”, “us” or “our”). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old and legally able to enter into a binding agreement to use the Site. By using the Site you represent that you meet these requirements.

3. Educational purpose only – not investment advice

CPI does not hold itself out as an investment adviser, a commodity trading advisor, a broker-dealer or a financial planner, and is not registered as such. All information and material provided through the Site is for educational and informational purposes only and must not be treated as investment advice or as a recommendation to buy, sell or hold any security, futures contract, commodity or other instrument.

Any opinions, research, analysis, prices or other information published on the Site are general market commentary. They do not take account of your personal objectives, financial situation or needs. You are solely responsible for your own trading and investment decisions, and you should consult a licensed professional before acting on anything you read, watch or hear here.

4. Risk acknowledgement

Trading futures, options and other leveraged instruments carries a substantial risk of loss and is not suitable for every investor. You may lose more than your initial investment. You acknowledge that you use the Site with full awareness of these risks and that you alone bear responsibility for any losses you incur.

5. No guarantee of results

Past performance is not indicative of future results. Nothing on the Site is a promise or guarantee of profit, income or any particular outcome. Where hypothetical or simulated results are discussed, you should understand that they have inherent limitations and do not represent actual trading.

6. Guests, sponsors and third-party content

The Site features interviews, guest contributors, sponsors and links to third-party websites and services. Views expressed by guests and contributors are their own and do not necessarily reflect those of CPI. Sponsorship or advertising does not constitute an endorsement, and we are not responsible for the content, products, services or practices of any third party. Your dealings with third parties are solely between you and them.

7. Email and newsletters

If you subscribe to a newsletter or other mailing, you consent to receive email from us at the address you provide. You may unsubscribe at any time using the link in any message. Subscribing does not create an advisory relationship of any kind.

8. Accounts

Some areas of the Site may require an account. You are responsible for keeping your login credentials confidential and for all activity that occurs under your account. Please tell us promptly if you believe your account has been used without your authorisation. We may suspend or close an account at our discretion, including where these Terms have been breached.

9. Intellectual property

All content on the Site – including text, graphics, logos, audio, video, charts, course material and the selection and arrangement of that content – is owned by CPI or its licensors and is protected by copyright, trademark and other laws. You may view, download and print content for your own personal, non-commercial use only.

You may not reproduce, republish, redistribute, sell, licence, broadcast or create derivative works from any part of the Site without our prior written permission. Short quotations for commentary or review are permitted where you credit AnthonyCrudele.com and link back to the source.

10. Acceptable use

You agree not to: use the Site for any unlawful purpose; attempt to gain unauthorised access to any part of the Site or its systems; interfere with or disrupt the Site; scrape, harvest or systematically extract data; upload malicious code; impersonate any person; or use the Site in a way that could damage or overburden it.

11. Content you submit

If you submit a comment, review, question or other material, you keep ownership of it, but you grant CPI a non-exclusive, worldwide, royalty-free licence to use, reproduce and display it in connection with the Site. You are responsible for what you submit and confirm you have the right to submit it. We may remove any submission at our discretion.

12. Disclaimer of warranties

The Site is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, CPI disclaims all warranties, express or implied, including any warranty of merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Site will be uninterrupted, error-free or free of harmful components, or that any information on it is accurate, complete or current.

13. Limitation of liability

To the fullest extent permitted by law, CPI and its officers, employees and contributors will not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of profits, revenue, data or trading losses, arising out of or connected with your use of the Site – whether based in contract, tort, negligence or any other theory, and even if we have been advised of the possibility of such damages.

14. Indemnification

You agree to indemnify and hold harmless CPI and its officers, employees and contributors from any claim, demand, loss, liability or expense (including reasonable legal fees) arising out of your use of the Site, your breach of these Terms, or your violation of any law or the rights of a third party.

15. Changes to the Site and to these Terms

We may modify, suspend or discontinue any part of the Site at any time. We may also update these Terms from time to time; the “last updated” date above will change when we do. Your continued use of the Site after an update means you accept the revised Terms.

16. Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including breach of these Terms. Sections which by their nature should survive termination – including intellectual property, disclaimers, limitation of liability and indemnification – will continue to apply.

17. Severability

If any provision of these Terms is found to be unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will stay in full force.

18. Governing law

These Terms are governed by the laws of the jurisdiction in which Crudele Productions Inc. is organised, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Site will be brought exclusively in the courts of that jurisdiction, and you consent to their jurisdiction.
